NOTIFICATION OF MY HUNGER STRIKE IN PROTEST OF HAMPSHIRE CONSTABULARY REFUSAL TO REMOVE FALSE, DEFAMATORY AND PSYCHOLOGICALLY DAMAGING INFORMATION HELD ON THEIR DATABASE UNDER MY NAME


My hunger strike commences today at 2pm. I intend to protest until Hampshire Constabulary confirm, in writing, that they have removed ALL false, defamatory and psychologically damaging information held on their database under my name. I am determined to see this protest to it’s ultimate, irreversible conclusion. If, by chance, I am detained under Section 2 of the Mental Health Act, I will comply until released and then resume protest by hunger strike. I will, eventually, take such action necessary to avoid further detention, abscond and see this protest to it’s ultimate conclusion. I am documenting this protest and posting my journals widely on social media. If I am forced to abscond then I will do so in bright spotlight of public scrutiny and die, if necessary, in real time, as the public watches.

 

I am taking this opportunity to remind everyone concerned that I am the beleaguered, single father to Meg, my mentally ill daughter. I have been advocating on behalf of Meg for around 18 of her 21 years, fighting to get her the professional help that she rightly deserves. Meg has been repeatedly failed by services over the years. We have both been, variously between us, abused and neglected by those same mental health practitioners charged with our care. This very same protest by way of hunger strike arises out of my experience with dishonest, incompetent and corrupt mental health practitioners. My grievance with Hampshire Constabulary is embedded within a wider grievance with clinicians and leadership at CAMHS, Bramblys Drive, Basingstoke and the wider Sussex Partnership NHS Foundation Trust. Those same clinicians and leaders have, provably MISREPRESENTED me, LIED to me, were DISHONEST with me, were DISHONEST while presenting me to clinicians and management in CMRHT Basingstoke, with my own GP, with their counterparts in CMHT The Bridge Centre, Basingstoke and Hampshire Constabulary.


The Parliamentary Health Service Ombudsman has failed to investigate my complaints and the investigation being carried out by the Health and Care Professions Council currently falls woefully short of expectations. I suffer, daily, from the intergenerational trauma incompetently and recklessly exposed by CAMHS art therapist, Sally Mungall, daily from trauma response to the appalling misrepresentation, dishonesty and lies revealed in my medical records and daily from the trauma response to actions taken by Hampshire Constabulary. I live, daily, in genuine fear, socially isolated and without reasonable expectation of the normal, free life that any of you readers take for granted.

My daughter, Meg, is still profoundly, mentally ill and continues to suffer, daily, hourly. Meg has, for many, many years been denied any vestige of normal life. Meg was denied a childhood and denied her teen age years. She recently turned 21 years old but is no better now than when I first took her to CAMHS in 2018. The only difference now is that she is sedated with Sirtraline, living a zombie like existence. I walked into CAMHS desperately in need of help. I walked out of CAMHS, traumatised. I honestly believe that I am better off dead. Meg now tells me that she feels that she would be better off dead.

Attention Andy Ashby.   You are copied into this ‘open letter’ because you need to understand the consequences of your failure to properly respond to my complaints made in 2022. Perhaps you might consider sharing this ‘open letter’ with Jane Padmore so that she can understand the consequences of her failures as CO of the Sussex Partnership NHS Foundation Trust. She naively assumed that the PHSO would make a prompt and thorough investigation into my complaints. Trust in the PHSO is misplaced. I would forward this ‘open letter’ directly to her but I fear that she will construe the courtesy as harassment.

1)      THE ISSUE

 

I AM NOT GUILTY OF ANY ‘VIOLENT’ OR ‘SEXUAL OFFENCES’. I CATAGORICALLY DID NOT ‘STALK’ NOR ‘HARASS’ ANYONE.

As far as I understand things, Hampshire Constabulary have recorded ‘occurrences’ accusing me of ‘stalking and harassment’ because 1) I sent my accuser a document of complaints lodged with the Patient Advisory Liaison Service within the Sussex Partnership NHS Foundation Trust out of professional courtesy and because I was aware that CAMHS general manager, Wanda Reynolds, who was managing the complaints at the time was likely being dishonest. I did not want Sally Mungall blindsided by my complaints at a later stage. I explained this in 2) a follow up letter asking for Sally Mungall’s help in understanding what had gone wrong during the time that I was under her mental health care. This follow up letter was sent in accordance with HCPC ethics and standards advice. Sally Mungall is a registrant of the HCPC and obliged to respond to my request. Both document and follow up letter were not known by me at the time to be ‘unwanted’. In fact, my follow up letter explicitly informed Sally Mungall that I would make no further contact should she advise me that such communication was ‘unwanted’.


As far as I understand things, Hampshire Constabulary has recorded an ‘offence’ under Category 2 ‘Violent and Sexual’ offences under a further category of ‘stalking and harassment’ because I sent my accuser a document and follow up letter that my accuser claims was ‘unwanted’ but that I had no reasonable expectation was ‘unwanted’. Hampshire Constabulary intends to retain the record of that ‘offence’ for at least 10 years at which time the record will be ‘reviewed’ and potentially stay on the database until I am 100 years old because I am now deemed to be a ‘risk’ to the public!!? because I sent a document and a follow up letter, both reasonable things for me to have done!!!


Unless, of course, Hampshire Constabulary has evidence to validate their refusal to remove this information. Does Hampshire Constabulary have evidence?

Wanda Reynolds, along with Information Governance at the Sussex Partnership, made every effort to withhold important information or delay my access to important information. I consider this to be tantamount to actual corruption. Information that did eventually find its way to me, inadvertently or otherwise, proves that Sally Mungall made contact with Hampshire Constabulary earlier around February 2022 because of me. Why was there a need for Sally Mungall to contact Hampshire Constabulary at this time? What was said and in what way did this inform decisions that led to Hampshire Constabulary visiting me at my home during September 2022 and recording and retaining false, defamatory and psychologically damaging information on their database?

I now also know that Sally Mungall was pathologically predisposed to abusing me during the time that I was under her mental healthcare. Disclosed records confirm that she was compromised by her own very strong counter-transference during our first meeting, before psychotherapy with her actually started. I believe Sally Mungall’s strong feeling of ‘being violated by the presence in the room’, her own counter-transference, informed by her own life experiences motivated her to abuse me during psychotherapy.

I now also know that I experienced my own transference during psychotherapy with Sally Mungall. I have endured literal years of intense therapy with four different psychotherapists since Sally Mungall. Those psychotherapists have been working to mend the damage done to me by Sally Mungall and contain the intergenerational trauma that she recklessly exposed.


Through the countless therapy sessions with all four therapists I now have a better understanding of transference and how it impacted me during my time with Sally Mungall. I likely experienced idealised transference or maternal transference during therapy with Sally Mungall. Transference is the expected, absolute necessary component of psychotherapy. Without transference there can be no effective therapy.

MY transference was used against me. I was turned into a monster because of my own transference. Sally Mungall, aided and abetted by her clinical cohorts including Wanda Reynolds, sought to prioritise their own personal interests above my own wellbeing, in a deliberate plan to manage professional reputations and the reputation of the Trust.


Evidence in my possession proves that Sally Mungall misled and misrepresented me, lied to my face and to other clinicians and leadership in order to frame a narrative that blamed me and absolved her.


There needs to be a full investigation into this matter. Unfortunately, those charged with the responsibilities to investigate have failed or are failing.


IF HAMPSHIRE CONSTABULARY HAVE ACTED ON ADDITIONAL UNDISCLOSED EVIDENCE THEN THEY SHOULD PRESENT IT TO ME SO THAT I MIGHT CHALLENGE THE VERACITY THEREOF.

 

The following is a brief recap


1)      I have been suffering, lifelong, from Complex PTSD as a result of physical and emotional abuse and neglect as a child.

2)      My daughter, Meg, has been suffering from a comorbidity of mental health issues since childhood, including a unique and particularly difficult form of OCD, trauma and autism.

3)      CAMHS, Bramblys Drive, Basingstoke, failed, on two historically separate occasions, to meet their professional obligation in tending to my daughter’s mental health issues and were incompetent and arguably, clinically negligent.

4)      I was psychologically abused by Sally Mungall, art therapist appointed by CAMHS, Bramblys Drive, Basingstoke to deliver ‘parent work’. Sally Mungall acted beyond her remit, incompetently unpacking intergenerational trauma and unable to contain transference and counter-transference within the therapeutic relationship. As a result I was re-traumatised and rendered suicidal.

5)      I was misrepresented, lied to, monitored, wrongly risk-assessed and dishonestly pathologised by Sally Mungall and her clinical cohorts and leadership staff at CAMHS, Bramblys Drive, Basingstoke and by Wanda Reynolds, General Manager at CAMHS.

6)      Leadership at CAMHS and the wider Sussex Partnership NHS Foundation Trust were negligent and dishonest in their managing of me which led to a suicide attempt by me and detention under Section 136 of the Mental Health Act in April 2022.

7)      Initial evidence that proved that I had been misrepresented, lied to, monitored, wrongly risk-assessed and dishonestly pathologised by staff at CAMHS, Bramblys Drive, Basingstoke was disclosed by Southern Health NHS Foundation Trust on the 15th June 2022 following an access to records request. This further traumatised me.

8)      My formal complaint lodged against CAMHS and the wider Sussex Partnership NHS Foundation Trust via PALS was incompetently investigated and I escalated my complaint to the Parliamentary Health Service Ombudsman.

9)      By September 2022 I had still not been accepted into the care of CMHT the Bridge Centre, Southern Health NHS Foundation Trust and my daughter, Meg, was still on a waiting list for psychotherapeutic intervention. I was still the main carer and sole advocate for my daughter’s mental health but very much on my own, burned out and alone.

10)  PHSO wrote to me telling me that a caseworker could not be allocated to my complaint for up to 11 months because of a Covid 19 backlog. PHSO eventually overlooked my complaint completely for over a year until my MP, Maria Miller intervened. In the meantime I was, again, suicidal.

11)  In an effort to understand the nature of the psychological abuse suffered by me at CAMHS and, following advice embedded within the Standards of Conduct, Performance and Ethics, published on the website of the Health and Care Professions Council, the regulatory body that Sally Mungall is registered with, I forwarded my documented PALS/PHSO complaint and then a polite letter directly to Sally Mungall using contact details published online through her Art Therapy website. I gave my written assurance that I would make no further contact if she informed me that contact made her uncomfortable. She did not reply but, instead, immediately informed Hampshire Constabulary.

12)  I was visited by PC Newstead on 25th September 2022 and advised to make no further contact with Sally Mungall. Despite being assured that ‘no further action’ would be taken and that I have ‘no criminal record’, Hampshire Constabulary are adamant in maintaining records of three ‘occurrences’ on their database that identify me by name as having committed an ‘offence’ of ‘unwanted contact’ following ‘ongoing harassment/stalking’ under a ‘Category 2 Violent and Sexual offences’ to be ‘reviewed’ in 10 years’ time because I am now deemed to be of ‘risk’ to the general public. It may even be that such records will be kept until I am 100 years old! The visit by PC Newstead was traumatising. Knowledge of records that identify me by name as having committed the offence alluded to above has been traumatising, exacerbated my Complex PTSD. I absolutely dispute Hampshire Constabulary’s contention that I committed an ‘offence’. I DID NOT COMMIT ANY ‘OFFENCE’. I HAVE NEVER STALKED OR HARASSED ANYONE AND I HAVE NEVER COMMITTED ANY VIOLENT OR SEXUAL OFFENCES. Indeed, Police Staff Amy Lowe 17010 replied to one of my enquiries dated 12th October, 2022 stating that PC Newstead’s visit to my home on the 25th September, 2022 ‘was not a harassment warning’ and yet ‘occurrences’ were entered onto the Hampshire Constabulary database under a heading of ‘stalking/harassment’. Those same ‘occurrences’ referred to a ‘continuation of ongoing harassment’!!??

13)   I complained to Hampshire Constabulary but my complaint was not upheld. I have been advised by Hampshire Constabulary that the records will remain on their database and that my only recourse is a judicial review. I have since been advised by multiple legal entities that a judicial review would cost me somewhere in the region of £30,000.

14)  Hampshire Constabulary have been particularly obstructive and it took me over a year of robust enquiry, through four separate departments, before they acknowledged the full details of the records and the false accusations being held against my name.

 

2)      HUNGER STRIKE


On the 21st of December, 2023, I widely shared an ‘open letter’ detailing my intention to protest CAMHS and CMHT in Basingstoke and Hampshire Constabulary by way of hunger strikes. The following is an extract taken from that ‘open letter’,

‘I am writing this ‘open letter’ out of abject frustration and with simmering anger over the way that my daughter and I have been treated by CAMHS, Basingstoke and continue to be treated by CMHT, Basingstoke.

I have spent inordinate amounts of time and effort advocating for the mental health welfare of Meg I have now exhausted my patience and goodwill after fighting to hold those responsible for abuse, neglect and damage of both of us to account. Finally, my good reputation in the face of disingenuous misrepresentation and spurious allegations has yet to be repaired.

I am now forced to resort to extreme measures in order that my grievances against CAMHS, Basingstoke, CMHT The Bridge Centre, Basingstoke and Hampshire Constabulary are addressed and resolved to my reasonable satisfaction.

To that end I am informing all addresses of this ‘open letter’ of my intentions going forward.

 

HUNGER STRIKES

FIRST HUNGER STRIKE reference to SOUTHERN HEALTH NHS FOUNDATION TRUST

Meg is currently part way through temporary work with CMHT psychotherapist, Stan Roman. There are three sessions left to be completed with Stan and we anticipate that work concluding by the middle of February 2024 at the latest. As yet, there are still no firm dates nor a named practitioner allocated for Meg’s recommended long term psychotherapy and no firm dates nor a named practitioner to continue ERP therapy. There is a promised ‘review’ at the end of Stan Roman’s temporary work but it is likely that Meg will face a further indeterminate wait for therapy. By the 8th of March 2024 it will have been two years since Meg was originally referred.

Unless there is a psychotherapist allocated to start the recommended long term work with Meg by 23RD February 2024 and a guarantee of seamless and timely transition into additional therapy if further therapy is needed I will immediately commence a hunger strike.

If Southern Health resolve the issues with appropriate and timely allocation of psychotherapy for my daughter within 6 weeks then I will end my hunger strike on or before the 5th April 2024.

SECOND HUNGER STRIKE reference to HAMPSHIRE CONSTABULARY

Hampshire Constabulary has repeatedly refused to remove information that identifies me from their database. As I understand things, that information identifies me as the suspect of an ‘offence’ of ‘unwanted contact’ with CAMHS art therapist, Sally Mungall. The ‘offence’ is being retained, allegedly, in accordance with Management of Police Information guidelines ( MoPI ) and falls under ‘Category 2 – violent and sexual offences’ and will be retained for at least 10 years.

This is an outrageous perversion of justice.

I have clearly demonstrated that the ‘contact’ with Sally Mungall was NOT ‘unwanted’, or that the ‘contact’ was, at least, made in goodwill following advice published on the British Association of Art Therapist website and, more pertinently, the Health and Care Professions Council, website. The first ‘contact’ with Sally Mungall was a complaint document sent to her out of professional courtesy. The second ‘contact’ made shortly after the first was asking for help in understanding what had gone wrong during my sessions with her at CAMHS, Bramblys Drive, Basingstoke during Sep to Dec 2021 and during the subsequent investigation that had misrepresented me in medical records. The second ‘contact’ even suggested that if Sally Mungall was feeling uncomfortable with my contact that she should let me know and I would contact her no further. She chose to immediately complain to Hampshire Constabulary.’

The first hunger strike was called off after Gemma Stubbington, Head of Nursing, Professions and Quality overseeing CMHT Basingstoke on behalf of Southern Health NHS Foundation Trust personally intervened and authorised mental health therapies for Meg.

The second hunger strike commenced on the 27th April, 2024 and carried on for nine weeks. My physical health was strictly monitored by CMHT, Basingstoke and I lost a quarter of my body weight. During the final five days of my protest I was absolutely nil by mouth, having also refused water and all other liquids. During that final week an ambulance was called on my behalf on two separate occasions and I was admitted into the Emergency Department at Basingstoke Hospital while, in the background, preparations were being made to detain me under Section 2 of the Mental Health Act. I called a temporary suspension to my second hunger strike on the 27th June, 2024.

I am committed to resuming my hunger strike commencing 2pm 6th January, 2025 in protest at Hampshire Constabulary and will continue until ALL false, defamatory and psychologically damaging information held on their database under my name is entirely removed.

 

  

3)      SOCIAL MEDIA CAMPAIGN


Part of the rationale for temporarily suspending my second hunger strike followed my new idea to carry out an intensive social media campaign so as to raise widespread public awareness of my story. My story needs to be told. It is in the public interest. I am now in the process of disseminating ALL the facts surrounding this case. It may be that others have been affected by the same individual clinicians or institutions or it may be that others across the country have similar grievances with mental health service providers either at CAMHS level or at Foundation Trust level. By publishing ALL the facts surrounding this cases, including names of individual clinicians and the wider institutions involved I create an authentic, personal story that other people can relate to. The events and circumstances that I am including in my story is based on verifiable, evidence-based facts. I will be explicit in identifying those incidences where I speculate or offer opinion

I also need to ensure that I have the widest available audience watching me when I recommence my hunger strike. There was absolutely NO movement by Hampshire Constabulary following nine weeks of hunger strike and the risk to my life. It will be interesting to see the reaction when my story is laid bare under public scrutiny and judged in the court of public opinion.

It may just be that my published story will lead to legal assistance and or intervention at the highest governmental, ministerial levels.

4)      LUKE MURPHY, MP


My case had been supported by the former MP for Basingstoke, Maria Miller. Maria intervened directly during the latter stages of my second hunger strike and had previously intervened when my initial formal complaint made in September 2022 against Sussex Partnership NHS Foundation Trust had been completely overlooked by the Parliamentary Health Service Ombudsman for over a year. Following the recent General Election, Luke Murphy is now the incumbent MP for Basingstoke. I appealed to Luke Murphy, as my parliamentary representative, to take up my case and forward it to the Home Office and to the Ministry of Justice. Luke’s caseworker, Aideen informed me by email on the 6th December, 2024 that Luke had written identical letters to both the Home Office and the Ministry of Justice asking for a review of my case.

 

 

5)      THE PHSO  AND THE HCPC

As this is the case it will move to a senior casework team. I apologise for the delay this will cause in us actioning your complaint. At this moment you have not been allocated a new caseworker, but when you are they will contact you to discuss your complaint.

That makes it more than 27MONTHS since I first made my complaint to the PHSO in September 2022!!! And still no confirmation as to when I can expect a caseworker to be appointed to my complaint. The following statement is copied and pasted directly from https://www.ombudsman.org.uk/

Is a 27 month wait for a caseworker normal for the PHSO or is it just me, personally? It feels  personal to me.

 

I received an email on the 9th December, 2024 from Claire Sharkey, new caseworker at the Health and Care Professions Council, informing me that only two out of seven issues raised in my ‘fitness to practice’ complaint against registrant, Sally Mungall, are to be referred to the HCPC Investigating Committee Panel. The ‘fitness to practice’ complaint is NEVER going to hold Sally Mungall to account for the damage done to me. The HCPC only ever carry out a ‘fitness to practice’ complaint in order to determine their registrants current and future fitness to practice. It is almost inevitable that their registrant, Sally Mungall, will avoid punitive sanctions because I am probably the only person damaged by her. With that in mind I would expect the HCPC to investigate their registrant FULLY, taking into account ALL the issues raised by me.

I do not expect justice to be served. Both my daughter, Meg and me, her single father and main carer, will forever remain victims of clinical abuse and negligence without recourse. To add insult to injury I am expected to spend the rest of my natural life under the shadow of a real injustice, forever regarded by Hampshire Constabulary as a ‘violent and sexual’ offender’ accused of ‘stalking and harassing’. That is NOT justice!!
