
'The Parliamentary and Health Service Ombudsman ( PHSO ) sits at the apex of the complaints process. It is the only organisation which handles complaints about government bodies and the NHS on behalf of the public. The popular concept of an Ombudsman is that it is a body which protects the citizen from an abuse of power, by holding an authority to account.
An ombudsman, ombudsperson, ombud, or public advocate is an official who is charged with representing the interests of the public by investigating and addressing complaints of maladministration or a violation of rights ( generic definition wiki.org )

I have just compiled an 86 page letter of complaint that will be addressed to the CO of the PHSO, Rebecca Hilsenrath, c/o Thomas Body early next week. I am currently waiting for Basingstoke MP, Luke Murphy, to complete his own letter to the PHSO to raise concerns on my behalf. When Luke is ready to forward his own letter then I will forward my 86 page letter of complaint at the same time. The first part of my letter of complaint is published here and details the chronology of my communication with the PHSO from the date that I first made my complaint on the 31st August, 2022 until the appointment of Thomas Body as senior caseworker to my complaint on the 17th January, 2025, nearly a full TWENTY-NINE MONTHS LATER!!

I am writing directly to you to complain about the recent decision made by senior caseworker, Thomas Body detailed in his letter dated 23rd April, 2025.
Thomas Body’s letter informs me that, ‘We have decided not to consider your complaint further. This is because, unfortunately, we are unable to agree our proposed complaint summary. Furthermore, we cannot achieve what you are seeking as an outcome to your complaint.’
I am formally setting out my complaint to this decision in accordance with the invitation to provide feedback within one month of Thomas Body’s letter. The following document should be considered, foremost, a complaint.
My complaint is in two parts.
1) The failure by the PHSO to address my initial complaint against the Sussex Partnership NHS Foundation Trust in a timely manner ( Page 1 ) and
2) The failure by Thomas Body to agree to investigate my complaint against the Sussex Partnership NHS Foundation Trust ( Page 4 ) .

1) The failure by the PHSO to address my initial complaint against the Sussex Partnership NHS Foundation Trust in a timely manner. Email evidence that supports the following timeline of events is presented as an addendum to this document beginning at page 15.
It took the PHSO over TWENTY-EIGHT MONTHS to appointment caseworker, Thomas Body to my complaint and over THIRTY-TWO MONTHS between my initial complaint being received by the PHSO and Thomas Body’s decision not to investigate my complaint. The current advisement found on the PHSO website suggests a waiting time of several months for complaints against the NHS to be processed by the PHSO.
31ST August, 2022. I originally signed in to the PHSO complaint service and had my complaint against the Sussex Partnership NHS Foundation Trust acknowledged and designated reference number ***********.
9th September, 2022. I was informed by PHSO ‘intake caseworker’, Katie Bailey that my complaint was being considered by the PHSO. My complaint was designated reference number *********.
16TH September, 2022. I was informed by Katie Bailey that there would be a significant delay of between 9 and 11 months in processing complaints due to a Covid 19 backlog.
16th September, 2022 onwards. I made multiple further submissions of evidence against the Trust following my own ongoing investigations, directing those submissions to Katie Bailey referencing the number *********, expanding my complaint accordingly.
25th September, 2023. In response to one particular further submission of evidence the PHSO wrongly generated a new claim and designated new reference number *********.
29th September, 2023. It had become apparent that the PHSO had entirely overlooked my original complaint against the Trust. I wrote to my MP, Maria Miller, asking for her assistance. Maria wrote to me confirming that she had written to the PHSO on my behalf.
17th October, 2023. I received a telephone call from PHSO caseworker, Mark Peirce who apologised for the delay in processing my complaint although he did not explain the reason for that delay. Mark Peirce advised me to make further enquiries to seek legal remedy through the courts and to return to the PHSO should such legal remedy be unavailable.
20th October, 2023. Mark Peirce wrote a letter to confirm what had been discussed on the 17th October, 2023 and I received that letter shortly after.
16th March, 2024. I sent multiple emails to Mark Peirce between October2023 and March 2024, updating him on my efforts to secure legal representation. I wrote an email to Mark Peirce on the 16th March, 2024 formally requesting that the PHSO take up my complaint. I did not receive a reply to this email.
16th April, 2024. I sent an email reminder to Mark Peirce, reiterating my request that the PHSO take up my complaint. I did not receive a reply to this email. It became apparent that I had been overlooked by the PHSO, AGAIN.
28th April, 2024. I wrote a new email to my MP, Maria Miller, again asking for her assistance in dealing with the PHSO.
12TH August, 2024. There was a General Election and a new MP was elected for Basingstoke in July, 2024. My case continued to be overlooked by the PHSO for over THREE MONTHS. Mark Peirce finally sent an email on the 12th August, 2024 but failed to explain why he had not replied to my emails in March and April. He informed me that my case had been ‘reopened’ and prioritized with a new designated reference number *********.
15th August, 2024. I received an ‘automated message’ from the PHSO informing me that my case had been assigned a caseworker, David Jagiello-Brown.
22nd August, 2024. Email received from PHSO caseworker, David Jagiello-Brown. While the email was addressed to me, ‘Dear Mr Stock’, the complaint summary referred to a ‘Mr Hann’!? The complaint summary was out of date and did not take into account the additional evidence that I had forwarded to The PHSO since 31st August, 2022
25th August, 2024. I forwarded a complete update to my complaint to David Jagiello-Brown, correcting his summary and reintroducing my revised complaint.
25th September, 2024. I received an email from David Jagiello-Brown informing me that my case is ‘more complex’ than originally deemed by the PHSO and would be awaiting allocation of a new caseworker. This is particularly frustrating as I had been updating the PHSO regularly since 31st August, 2022 on the details of my continued investigations of the Trust AND had informed PHSO caseworker, Mark Peirce of those same updates in detail when speaking to him on the telephone.
6th January, 2025. I was contacted by PHSO senior caseworker, Kirsty Fitzsimons, via email and informed that she had been appointed to my complaint against the Trust.
14th January, 2025. I was contacted by PHSO senior caseworker, Kirsty Fitzsimons, via email and informed that, due to a conflict of interest, she would no longer be investigating my complaint against the Trust. My complaint was to be allocated to a different caseworker.
17th January, 2025. I was informed, via email, that senior caseworker, Thomas Body, had been allocated to my complaint against the Trust.
The entire fiasco, from the date that I had originally made my complaint on the 31st August, 2022 until Thomas Body had been allocated to my complaint had taken the PHSO almost TWENTY-NINE MONTHS!!'
Thomas Body, on behalf of the PHSO, has stubbornly refused to agree the scope of my complaint against the Sussex Partnership NHS Foundation Trust. As a reminder to my readers, senior caseworker, Thomas Body forwarded the following

Thank you for your patience while I considered the information you have kindly provided.
I can see this has been an extremely distressing time for you and will do my best to ensure I deal with your concerns as efficiently and effectively as possible.
I have looked through the information you have provided and your open letter (dated 6 January 2025) and there are several points I would like to raise and things I would like you to consider.
First and foremost, for us to consider your daughters complaint we will need to contact her and ask for her consent to ensure she is completely happy for you to represent her. This is a legal requirement and something we must ensure we do. As such, please can you provide details for me to contact Megan so I can have a discussion with her?
In respect to points you have raised in your letter, it appears that a large number are not ready for our office to consider, and these will need to be directed at the Trust first. In the 52-page document you sent to me, you listed a number of grievances. There are 15 in total that I have broken down into Megs care, your complaint about Sally, and general broad questions and issues.
I can also see you were previously in contact with my colleague, David Jagiello and on 22 August 2024 he emailed you and shared a proposed complaint summary. This outlined the points he felt we could look at and the injustice you were claim and outcomes we could potentially achieve.
The summary was as follows;
Mr Stock complaints about the following issues that occurred at Sussex Partnership NHS Foundation Trust (the Trust) between 2 September 2021 to 23 December 2021
He feels during therapy sessions, the sessions turned into unofficial therapy sessions for him.
He complains that these sessions were stopped without coming to an actual conclusion.
The notes about him were not accurate and inappropriate.
How this affected you
Mr Stock says the was suicidal and tried to take his own life on 27 Aril 2023 leading to him being sectioned. He is also having to now pay for private therapy sessions.
What you hope to achieve
Mr Stock says he wants answers to his question to move forward with his therapy. He wants to be financially compensated to pay for therapy he is having because of what happened at the Trust. You want to make sure the Trust has shared your complaint with staff to improve its service (service improvements). You would also like an apology from the Trust.
David also explained that we are unable to provide answers on behalf of the Trust.
Having read your correspondence, I agree with David’s summary (even after your 23-point response to him), and I believe this encapsulates the relevant aspects of the 23 issues you sent to us and the later 15-point response.
Can you confirm if you are happy with my summary of the case? This will mean we can progress the case as efficiently as possible if we decide to do so. ultimately, although, I appreciate it is your complaint, it is our investigation, and it is for us to determine what points we can and cannot look at. However, before that I have a few questions I would like to ask you.
Firstly, can you please tell me how much financial remedy you are seeking in respect to future therapy sessions and to remedy your complaint?
You have also said in your recent open letter, that it will: ‘be widely distributed to lawyers and solicitors throughout the UK’. As such, can you please tell me if you are pursing legal action and if not, why not?
Can you also please tell me if there is any active police investigation currently ongoing?
Can you confirm what specific questions you wanted the Trust to answer as part of your desired outcome?
Can you also please tell me exactly what outcomes you wish to achieve? This will help me understand and determine what we can and cannot achieve if we do look at the case.
Finally, in relation to your public blog, can I kindly ask if you will not share any information regarding our communication with you, as we try and carry out all our investigations in private. You are under no obligation to do so, but I believe it would help matters if you do not share information publicly at this stage.
If you have any questions, please feel free to let me know. Once I have your response, I will be in a better position to progress the case.

There were points in Thomas Body’s summary that I needed to correct and I sent him those corrections, along with document 'PHSO THE SPECIFIC QUESTIONS I WANT ANSWERED AS PART OF MY DESIRED OUTCOME' by way of email on Friday, March 21, 2025 1:04 PM, 2025. There were 73 important, carefully considered and technically pertinent questions embedded in contextually appropriate account of events in that document. These questions were in response to Thomas Body’s own request, ‘Can you confirm what specific questions you wanted the Trust to answer as part of your desired outcome?’
Thomas Body has since repeatedly informed me that the PHSO will NOT present my 73 questions to the Trust. His final written word on the subject of the 73 questions was delivered in a wider email

For the record, neither Thomas Body nor the wider PHSO has EVER addressed this point in detail. Thomas Body has simply explained, ad nauseum, that the PHSO will not put my questions to the Trust.
As far as I am concerned, by refusing to ask the Trust to answer my 73 questions, the PHSO is refusing to carry out its fundamental duty to INVESTIGATE my complaint.
Because I will not accept Thomas Body or the wider PHSO’s refusal to ask the Trust my 73 questions, Thomas Body has closed my case, citing a failure to agree to the ‘scope’ of my complaint.
I have since become aware of the service users advocacy group PHSOtheFACTS. I ordered a copy of Della Reynolds book 'What's the point of the Ombudsman?' which was delivered to me yesterday. Even though I have only just started reading this 579 page tome I am already appalled as I begin to learn of the experiences of countless other service users who have already sought help from the Parliamentary Health Service Ombudsman and found this regulator to be grossly flawed. To quote from the back of the book
'A state captured 'regulator' is worse than no regulator at all. The flawed PHSO process gives an illusion of accountability for public bodies where none exists. It validates poor performance, condoning the harm caused to citizens. It allows politicians to abslove their responsibilty to the public as they knowingly refer cases into oblivion. With unforgivable cruelty it sets up false hope, resulting in victims of injustice wasting many hours, months and years repeatedly putting the facts before an orginisation which is institutionally deaf and blind to them.'
I will now be writing to PHSOtheFacts and inviting them to follow this blog and to follow my next phase of theatrical and provocative, public protest against inaction and injustice due to commence later next month. I will write more about that next phase of protest in my next installment of LATEST ISSUES.

I have already engaged my local MP and will be mounting high-profile and very public protests against the Trust AND the PHSO commencing in June this year.
I CANNOT allow the serious clinical negligence and reputational abuse of me by clinicians and leadership at CAMHS Basingstoke and the wider Sussex Partnership NHS Foundation Trust to go unaccounted. If you wish to make a complaint about the service you have received, the first step is for me to make my manager aware of this. If you are unhappy with PHSO’s powers and legislation you may wish to contact your MP directly.
Again, I am sorry you are unhappy with our complaint summary but if you are unable to agree, it is likely we will have to withdraw your complaint.
I will speak to my manager again regarding your concerns.
